KiddyList collects some Personal Data from its Users.

This document contains a section dedicated to Californian consumers and their privacy rights.

This document can be printed for reference by using the print command in the settings of any browser.

Person responsible under data protection law

This privacy policy informs you, among other things, about the scope, purpose and legal basis of the processing of personal data collected via the "KiddyList" APP.

Personal data is any information that relates to a natural person, i.e. with which a natural person can be directly or indirectly identified, e.g. by name, e-mail address, account number or IP address (list not exhaustive). The responsible person in terms of data protection law are Lorenzo Bennicelli and Marco Gandolfo e-mail: info@melograpp.com (hereinafter "responsible person" or "we").

Download of the app: platform services and hosting

These services have the purpose of hosting and running key components of KiddyList, therefore allowing the provision of KiddyList from within a unified platform. Such platforms provide a wide range of tools to the Owner – e.g. analytics, user registration, commenting, database management, e-commerce, payment processing – that imply the collection and handling of Personal Data.

When downloading the mobile app, the information required for this is transferred to the respective app store (Apple Store or Google Play Store), i.e. in particular your user name, email address and customer number of your account, time of download, payment information and the individual device identification number.

We have no influence on this data collection by the App Store and are not responsible for it. We process the data only to the extent necessary to download the mobile app to your mobile device.

Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored. Google Play Store (Google LLC)

Use of the app

In principle, no registration is required to use the app and the services we offer via it.
When using the mobile app on your device we do not collect personal data.

When using the mobile app on your end device, we collect the personal data described below.
This data is technically required to offer you the functions of our mobile app and to ensure stability and security:

- IP address
- Date and time of the request
- Time zone difference to Greenwich Mean Time (GMT)
- Operating system

‍ This data is processed by us for the following purposes:

- Ensuring comfortable use of the app,
- Ensuring and evaluating system security and stability, and
- anonymised for further administrative purposes.

The legal basis for the processing is Article 6 Paragraph 1 Clause 1 Letter f of the GDPR.
Our legitimate interest follows from the data collection purposes listed above.

Your personal information will be processed in a fashion necessary and proportionate to the business purpose and strictly within the limits of compatible operational purposes.

Use of cookies

We do not use cookies.

Access rights on your terminal device.

The app does not require access rights on your device.

Storage permission

Used for accessing shared external storage, including the reading and adding of any items.

Depending on the User's specific device, KiddyList may request certain permissions that allow it to access the User's device Data as described below.
The permissions can be revoked by the User at any time.
In order to revoke these permissions, Users may refer to the device settings or contact the Owner for support at the contact details provided in the present document.

Please note that the revoking of such permissions might impact the proper functioning of KiddyList.

Contact Information

If you contact us it is necessary to provide your name and your e-mail address so that we can process and answer it.
Further information can be provided voluntarily. We will only process the data transmitted for the purpose of establishing contact to process your request.

The legal basis for this data processing is Article 6 Paragraph 1 Clause 1 Letter b) GDPR, insofar as it is a pre-contractual measure, and Article 6 Paragraph 1 Letter a) based on your consent.

The personal data collected in this way will be deleted if they are no longer required and if there are no legal storage requirements to prevent deletion.

Advertising

This type of service allows User Data to be utilized for advertising communication purposes.
These communications are displayed in the form of banners and other advertisements on KiddyList, possibly based on User interests.
This does not mean that all Personal Data are used for this purpose.
Information and conditions of use are shown below.

Some of the services listed below may use Trackers to identify Users or they may use the behavioral retargeting technique, i.e. displaying ads tailored to the User’s interests and behavior, including those detected outside KiddyList.
For more information, please check the privacy policies of the relevant services. Services of this kind usually offer the possibility to opt out of such tracking.
In addition to any opt-out feature offered by any of the services below, Users may learn more on how to generally opt out of interest-based advertising within the dedicated section "How to opt-out of interest-based advertising" in this document.

AdMob

(Google LLC) AdMob is an advertising service provided by AdMob Google Inc.
In order to understand Google's use of Data, consult Google's partner policy.

Personal Data processed: Cookies; unique device identifiers for advertising (Google Advertiser ID or IDFA, for example); Usage Data.
Place of processing: United States – Privacy PolicyOpt Out.
Category of personal information collected according to CCPA: identifiers; internet information.
This processing constitutes a sale based on the definition under the CCPA. In addition to the information in this clause, the User can find information regarding how to opt out of the sale in the section detailing the rights of Californian consumers.

Disclosure of Personal Data

In principle, we do not pass on any personal data to third parties, unless

- You have expressly given your consent in accordance with Article 6 Paragraph 1 Clause 1 Letter a GDPR
- This is permitted by law and required for the processing of the contractual relationship with you according to Article 6 Paragraph 1 Sentence 1 lit. b GDPR
- There is a legitimate interest in the disclosure according to Article 6 Paragraph 1 Sentence 1 lit. f GDPR and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data, as well as
- there is a legal obligation for the disclosure according to Art. 6 para. 1 p. 1 lit. c GDPR.

Retention Periods and Deletion of Data

The personal data collected by the persons responsible will be deleted if they are no longer required to fulfill the contract or if the agreed purpose of use no longer applies and there are no legal storage obligations to the contrary.

Additional information about Data collection and processing

Legal action

The User's Personal Data may be used for legal purposes by the Owner in Court or in the stages leading to possible legal action arising from improper use of KiddyList or the related Services.
The User declares to be aware that the Owner may be required to reveal personal data upon request of public authorities.

System logs and maintenance

For operation and maintenance purposes, KiddyList and any third-party services may collect files that record interaction with KiddyList (System logs) use other Personal Data (such as the IP Address) for this purpose.

More details concerning the collection or processing of Personal Data may be requested from the Owner at any time.

How “Do Not Track” requests are handled

KiddyList does not support “Do Not Track” requests.
To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.

Your Rights

You have the following rights towards us with regard to your personal data:

- to request information about your personal data processed by us in accordance with Art. 15 GDPR;
- to request the correction of incorrect or incomplete personal data stored by us in accordance with Art. 16 GDPR;
- to request the deletion of your personal data stored by us in accordance with Art. 17 GDPR;
- to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR;
- in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request transmission to another person responsible;
- to complain to a supervisory authority in accordance with Art. 77 GDPR.

Withdrawing Your Consent

Is the data processing based on your consent in accordance with Article 6 Paragraph 1 lit. GDPR, you can revoke this consent to the person responsible at any time with effect for the future (Art. 7 Para. 3 GDPR).
As a result, we are no longer allowed to continue the data processing based on your consent for the future. An e-mail to info@melograpp.com is sufficient for a revocation.

Right of objection

You can object to the processing of your data at any time with effect for the future. An e-mail to info@melograpp.com is sufficient for a revocation.

Reservation of right to change the privacy policy

The Owner reserves the right to make changes to this privacy policy at any time by notifying its Users on this page and possibly within KiddyList as far as technically and legally feasible.
It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom and enable the automatic update of the app in order to be notified.

Information for Californian consumers

This part of the document integrates information contained in the rest of the privacy policy regarding how KiddyList collects your data (for the purposes of this section referred to collectively as “we”, “us”, “our”).

The provisions contained in this section apply to all Users who are consumers residing in the state of California, United States of America, according to "The California Consumer Privacy Act of 2018" (Users are referred to below, simply as “you”, “your”, “yours”), and, for such consumers, these provisions supersede any other possibly divergent or conflicting provisions contained in the privacy policy.

This part of the document uses the term “personal information“ as it is defined in The California Consumer Privacy Act (CCPA).

Categories of personal information collected, disclosed or sold

Information we collect

We have collected the following categories of personal information about you: identifiers, commercial information, internet information, geolocation data and sensorial information.

How we collect information

We collect the above mentioned categories of personal information, either directly or indirectly, from you when you use KiddyList.

How we use the information we collect

We may use or disclose the personal information we collect about you to a third party to allow the operational functioning of KiddyList and features thereof (“business purposes”).

Sale of your personal information

For our purposes, the word “sale” means any “selling, renting, releasing, disclosing, disseminating, making available, transferring or otherwise communicating orally, in writing, or by electronic means, a consumer's personal information by the business to another business or a third party, for monetary or other valuable consideration” (for example, when an application runs ads, makes statistical analyses or simply because it uses tools such as social network plugins).

Your right to opt out of the sale of personal information

You have the right to opt out of the sale of your personal information. This means that whenever you request us to stop selling your data, we will abide by your request. Feel free to contact us info@melograpp.com submitting any verifiable request or if you'd simply like to know more about your right to opt out.

We will not use your personal information for different, unrelated, or incompatible purposes without notifying you.

Your California privacy rights and how to exercise them

The right to know

You have the right to request that we disclose to you the categories and sources of the personal information that we collect about you, the purposes for which we use your information and with whom such information is shared.

The right to request the deletion of your personal information

You have the right to request that we delete any of your personal information subject to exceptions set forth by the law and if it is not related to information collected by third part services: we have no influence on this data collection and are not responsible for it.

If no exception applies we will delete your personal information.

How to exercise your rights

Submit your verifiable request to us by contacting us info@melograpp.com.

We are committed to respond to your request as soon as possible with the necessary condition to know who you are or providing sufficient information that allows us to reasonably verify you are the person about whom we collected personal information.

If you cannot personally submit a verifiable request, you can authorize a person registered with the California Secretary of State to act on your behalf. If you are an adult, you can make a verifiable request on behalf of a minor under your parental authority.

You can submit a maximum number of 2 requests over a period of 12 months.

How and when we handle your request

We are committed to respond to your request as soon as possible (if we need more time we will explain to you the reasons why and how much more time we need) providing information about how we will process your request.

If we should deny your request we will explain you the reasons behind our denial.

We do not charge a fee to process or respond to your verifiable request unless such request is manifestly unfounded or excessive. In such cases we may simply refuse to act on the request. In this case we will communicate our choices and explain the reasons behind it.
